Monetization Policy

PLEASE READ THIS MONETIZATION POLICY (THE “POLICY”) CAREFULLY.  This Policy is subject to and incorporated by reference into the Special Terms of Service located here (the “Terms”) and this Policy will be deemed part of the Acceptable Use Policy in the Terms.  Capitalized terms not defined in this Policy will have the meanings set forth in the Terms.

CREATORS MAY NOT MONITIZE USER CONTENT THROUGH THE SERVICES, WHETHER VIA A MEMBERSHIP, THE PLACEMENT OF ADVERTISEMENTS, OR OTHERWISE, UNLESS YOU OWN OR HAVE ALL NECESSARY RIGHTS TO COMMERCIALLY USE ALL AUDIO AND VISUAL ELEMENTS OF SUCH USER CONTENT.

If you created the User Content, you can usually monetize the User Content, provided, however, that you still hold the rights to the video and have not granted to any other party any such rights in the User Content that would prevent you from monetizing the User Content.

However, even if you have recorded the content yourself (i.e., recording of public events, recording from TV, DVD, CD), usually the original creator or author of the underlying content holds the rights needed to commercially exploit this content.  As a result, you will need explicit, written permission from the original rights holder.

If the User Content is created using third party software, the terms of the license may limit your use of such User Content for commercial use.  You will need to review the terms of any such license.

If the User Content contains any content that you did not create, such as content obtained from a third party, you must have explicit, written permission from the third party granting you commercial use rights with respect to such content.  In addition, your use of such content may require that you credit the creator of the content or give proof of purchase in your use of such content.  You will need to review the terms, including any licenses, applicable to such content to ensure you have all necessary rights to monetize the content.

However, even if you have purchased the content yourself, usually the original creator or author holds many of the rights needed to commercially exploit this content.  As a result, you cannot monetize third-party content you have purchased unless the original rights holder grants you commercial use rights.

In all cases, you must be able to demonstrate that you own or have all necessary rights to commercially use all content included in the User Content you monetize via the Services.

by publishing any user content for monetization via the services, you represent and warrant that you own or have all necessary RIGHTS TO COMMERCIALLY USE ALL AUDIO AND VISUAL ELEMENTS OF SUCH USER CONTENT.
